In divorce, asset division depends on the marital regime: partial community (joint assets split equally, personal assets remain separate, CC arts. 1.658-1.666); universal community (all assets split in half, arts. 1.667-1.671); final share of acquired assets (each spouse manages their own property during the marriage and, upon dissolution, is entitled to a credit equal to half of what the other acquired for value, arts. 1.672-1.686); conventional or mandatory separation (no division of joint assets, arts. 1.687-1.688 and 1.641). In estate proceedings, the surviving spouse has a community share (or the equivalent credit, under final share of acquired assets) in joint assets, and the remaining assets are distributed among heirs in the order of inheritance (CC art. 1.829). Necessary heirs are entitled to 50% of the net estate (art. 1.846 CC).
