ADC 58 (STF): exclusive SELIC from filing to 29/08/2024; IPCA + Legal Rate from 30/08/2024 (Law 14.905/2024). The tool applies each regime per pay period according to the dates you enter.
Build a labor calculation spreadsheet with claim items, INSS, DSR and ADC 58 indexation.
After a Brazilian labor ruling decides which amounts are owed, someone has to turn those amounts into an exact figure, that is the liquidation phase. It is not a simple sum: each claim is computed by pay period (month by month), generates reflexos such as DSR on habitual overtime, is subject to INSS deductions per pay period, and is adjusted for inflation. Since the STF's decision in ADC 58 (2021), reaffirmed by Law 14.905/2024, that adjustment follows a specific regime of indices and interest. This calculator builds the worksheet item by item applying those rules, to serve as an estimate and cross-check, it does not replace the court expert's calculation or judicial approval.
A Brazilian labor case has a merits phase, in which the judge decides what is owed, and a liquidation/enforcement phase, in which the amount in reais is worked out. The calculator operates in that second phase: you already have the list of claims recognized in the ruling (overtime, additionals, salary differences, severance items, and so on) and need to reach the updated value with the legal deductions.
Each claim needs three key pieces of information: the computed amount, the pay period (the month it refers to) and which incidences fall on it. The pay period matters because both the inflation adjustment and the INSS table are applied according to the date of each installment, not to a generic total.
DSR reflexo: habitual overtime generates a reflexo on the paid weekly rest (DSR). The usual computation (Law 605/1949, TST Precedent 172) divides the amount by the working days in the month and multiplies by Sundays and holidays. Example: R$ 660 of overtime in a month with 22 working days and 5 rest days yields DSR ≈ (660 ÷ 22) × 5 = R$ 150. The tool computes this reflexo automatically for items flagged with DSR.
INSS per pay period: the social-security deduction applies to the base (claim + DSR, when applicable) using the table in force for that pay period. Items of indemnity nature, such as the 40% FGTS penalty or moral-damages compensation, carry no INSS; that is why you uncheck the incidence on those lines. The final result shows gross, DSR, INSS deducted, and the already-updated total.
For the judicial phase, ADC 58 set the SELIC rate (which already bundles inflation adjustment and interest) applying from the filing date. With Law 14.905/2024, from 30/08/2024 onward the update combines IPCA as the inflation index and the Legal Rate (interest equal to SELIC minus IPCA) as interest.
In practice, the tool applies accumulated SELIC from the filing date to 29/08/2024 and, from 30/08/2024, IPCA + Legal Rate, per pay period. Because these indices change month by month, the updated total depends on the dates you enter, which is why the filing date and target date are required fields. IRRF/RRA (art. 12-A of Law 7.713/1988) applies to the updated total divided by the number of months in the period, using the progressive table, and should be confirmed with an accountant or via eSocial.
