The fractions that unlock each stage

Serving a sentence in Brazil is a progressive process: the convict moves from the strictest regime to the most lenient one as part of the sentence is served and behavioral requirements are met. Each stage, regime progression and conditional release, unlocks once a fraction of the sentence is reached. Those fractions are set out in art. 112 of the LEP and art. 83 of the Criminal Code, and they vary according to the type of crime and whether the convict is a first offender or a recidivist.

The reference point is the date of the offense, which decides which of three fraction sets applies. Offenses up to 22 Jan 2020 follow the old rule (1/6 for ordinary crimes; 2/5 and 3/5 for heinous crimes, under Law 11.464/2007). Offenses from 23 Jan 2020 to 24 Mar 2026 follow the Anticrime Package (Law 13.964/2019). Offenses on or after 25 Mar 2026 follow Law 15.358/2026 (the Antifacção Law), which raised the fractions for heinous crimes and for leadership of ultraviolent criminal organizations.

From gross sentence to progression milestones

The calculation converts the total sentence into days and applies the progression fraction to that total; only afterward does it deduct pretrial detention credit (Criminal Code art. 42) and remission earned through work and study. This order, applying the fraction before subtracting days already served, is the one courts treat as most favorable to the convict, and it avoids subtracting detention credit and remission twice.

Picture a first offender convicted of an ordinary crime without violence, whose progression fraction is 16%. Applying that fraction to the total sentence, the tool adds the result to the sentence start date and deducts the recognized detention-credit and remission days, estimating the date on which they may progress to the semi-open regime, along with the conditional release date (art. 83 of the Criminal Code) and the sentence end date. These are eligibility estimates: the final decision always rests with the sentence-execution court.

Remission, serious misconduct, and judicial decision

Remission reduces the sentence: for every 3 days of recognized work, 1 day is deducted; for every 12 hours of formal study, 1 day (LEP art. 126). But committing a serious disciplinary offense can revoke up to 1/3 of the remitted days accumulated (LEP art. 127), pushing the milestones back. The calculator factors these effects in when computing net remission.

Reaching the fraction is a necessary but not sufficient condition. Since Law 14.843/2024, progression requires a criminological report in every case, plus a certificate of good conduct from the institution, and a judicial decision. In addition, conditional release is barred for a specific recidivist in a heinous crime resulting in death (art. 83, sole paragraph, of the Criminal Code) and, since Law 15.358/2026, also in the highest brackets of LEP art. 112. Treat the result as an estimate and confirm it with an attorney.
