If the debtor does not pay within 15 days of notice to comply (CPC art. 523 §1), a 10% penalty and 10% attorney fees apply to the amount due.
Build civil judgment worksheet with multiple claims, CPC 523 penalty, and attorney fees.
Once a civil judgment becomes final, the award must be turned into an exact figure for enforcement (cumprimento de sentença), and an award usually has several "chapters" (for example, the principal amount, moral damages, court costs), which may carry different milestones and indices. This tool builds the liquidation worksheet (CPC arts. 509–514), updating each chapter under the STJ regime (Tema 1.368 combined with Law 14.905/2024), adding the 10% penalty of CPC art. 523 §1 when applicable, the attorney fees, and the deduction of amounts already paid. It is an educational estimate for cross-checking, it does not replace the court accountant's calculation or judicial approval.
Liquidation is the stage that puts a figure on the award before enforcement. When the value can be reached by simple arithmetic, it is called liquidation by calculation, exactly the scenario of this worksheet, which starts from known amounts and dates.
A judgment rarely awards a single value: it has chapters, the autonomous parts of the decision (the principal, moral damages, costs, each with its own date and sometimes its own index). Treating each chapter separately avoids applying the same correction milestone to amounts that arose at different moments.
The date entered for each chapter matters, because it changes with the nature of the debt: for a liquid contractual debt with a definite due date, it is the due date itself (Brazilian Civil Code, art. 397); for an obligation with no fixed due date, it runs from service of process (art. 405); for extracontractual property damage, from the harmful event itself (STJ Precedent 43); and for moral damages, monetary correction runs from the date the amount was set (arbitramento, the ruling that fixed the value) while default interest runs from the harmful event, two different milestones (STJ Precedents 362 and 54). The tool uses a single date per chapter, so enter whichever milestone matches what you are calculating.
CPC 523 penalty: once notified to pay, the debtor has 15 days. If they do not pay, a 10% penalty plus 10% attorney fees apply to the amount due (art. 523 §1). On an updated award of R$ 20,000, for example, that means R$ 2,000 in penalty and R$ 2,000 in fees added to the debt, a total of R$ 24,000. The tool computes these add-ons when you check the option.
Deduction: payments the debtor has already made are subtracted from the total. In this version, the deduction is taken at the nominal amount entered; if the payment was late, strict practice requires updating it to the actual payment date before deducting. It is worth confirming this detail with the accountant's calculation.
For civil debts, the STJ consolidated in Tema 1.368, in line with Law 14.905/2024, the update regime: full SELIC until 29/08/2024 and, from 30/08/2024, IPCA for monetary correction plus the Legal Rate for interest. Each chapter is corrected by the index of its period.
On attorney fees, the general rule of CPC art. 85 sets them on the total liquidation result; even so, the tool allows per-chapter calculation when the case file orders otherwise. Because these are sensitive amounts and deadlines, use the result as an estimate and confirm with a qualified professional.
Paste the code into your HTML and the tool shows up on your page, without J-Kit's navigation and ads. It still runs in the browser of whoever visits your site.
