Civil Judgment Liquidation in Brazil: How the CPC Article 523 Calculation Works

Brazilian civil judgment liquidation turns a generic conviction into a liquid, enforceable amount, and the final total is not just the original award added up: the order in which monetary correction, default interest, the CPC Article 523 penalty and post-judgment legal fees apply changes the result. Why the order of each step changes the final amount

A Brazilian civil judgment can order the defendant to pay more than one item at the same time, for example material damages and moral damages, and each conviction chapter carries its own due date. CPC (the Code of Civil Procedure) articles 509 through 514 treat liquidation as a phase of the underlying lawsuit itself whenever no complex accounting expert report is needed, and the spreadsheet only adds up the final total after correcting and applying default interest to each chapter separately: a chapter that fell due in 2020 accumulates a different correction factor than a chapter that fell due in 2023, so treating every value as if it shared the same due date distorts the result.
Following STJ Tema 1.368 and Lei 14.905/2024, the update regime for civil debts shifted: through August 29, 2024, monetary correction used the SELIC rate as a single combined index, folding correction and interest into one rate, and starting August 30, 2024 it switched to adding the IPCA inflation index as the correction component plus a separate legal interest rate calculated on its own. This calculator applies the currently maintained official series for each stretch of the period automatically, so the user never has to switch indexes by hand. Once corrected and with interest added, each chapter's amount still receives the 10% penalty under CPC Article 523, §1, whenever the debtor fails to pay within 15 days of being notified, plus post-judgment legal fees: both apply to the value that is already updated, not to the conviction's historical value, which means the penalty's calculation base grows along with the time elapsed until liquidation.
The real trap in this calculation shows up when one of the chapters is moral damages. Under STJ Súmula 362, monetary correction on moral damages counts from the date the award was set, meaning the date of the ruling that fixed the amount, not from the date of the underlying wrongdoing; default interest, on the other hand, counts from the wrongful event itself in cases of tort liability, under STJ Súmula 54. Using the same due date for both markers in a moral-damages chapter, copying the criterion used for a material-damages chapter, produces a correction value that is either too high or too low; that is why each chapter of this kind needs its due date adjusted to whichever marker the party intends to apply.

This is a hypothetical example, not an amount owed to anyone: the penalty and the legal fees, both 10%, apply to the already-corrected and interest-bearing R$ 17,157.80, not to the original R$ 10,000.00, which shows why the order of application decides the total.

The 10% penalty only applies when the debtor fails to pay within 15 days of notification (CPC Article 523, §1); if voluntary payment already occurred, removing it avoids charging an amount the law does not authorize in that case.

The calculator deducts the prior payment at the nominal amount entered, without correcting it; if the payment happened well after the chapter's due date, technical rigor requires correcting that amount up to the payment date before deducting it, and the calculator itself warns about this.
