Brazil Retirement Simulator: How the 5 EC 103/2019 Rules Work

After Constitutional Amendment 103/2019, there is no single "retirement rule": whoever was already contributing before 11/13/2019 can fit up to five different rules at the same time, and the most advantageous one is not always the most obvious. This simulator runs the definitive rule and the four transition rules in parallel over the same history and reports which ones have already been reached.

The Five Rules EC 103/2019 May Apply to the Same Case

The initial monthly benefit (RMI) uses the same coefficient in almost every rule: 60% of the average wage plus 2% per year of contribution beyond the minimum time (20 years for men, 15 for women), up to a 100% ceiling. In a simulation with 38 years of contribution and an average wage of R$ 3,000.00, the 18-year excess adds 36 percentage points to the initial 60%, resulting in a 96% coefficient and an RMI of R$ 2,880.00; the only exception is the 100% toll rule (art. 20), which fixes the coefficient at 100% of the average without applying this formula.
The points rule (art. 15) sums age and contribution time against a total that rises 1 point per year from the 2019 baseline (96 for men, 86 for women) until it locks at 105 (men, from 2028) and 100 (women, from 2033); the progressive minimum age rule (art. 16) does the same with age, rising 6 months per year from 61 (men) and 56 (women) until locking at 65 and 62. The two transition rules can reach different results for the same person, because one weighs contribution time more and the other weighs age more.
The real trap sits in the two toll rules: the 50% toll (art. 17) only applies to whoever had up to 2 years (730 days) left to complete the full time on 11/13/2019, requires meeting 1.5 times that remaining time, has no minimum age, and uses the normal coefficient formula; the 100% toll (art. 20) applies regardless of how much time was left, requires double that remaining time plus a fixed minimum age (60 for men, 57 for women), but in exchange fixes the RMI at 100% of the average, without depending on the excess-years coefficient. Confusing the two leads to wrong estimates of timing or benefit amount.

Is one of the EC 103/2019 rules always the best?

There is no single answer: the most advantageous rule depends on each person history, since age, contribution time and average wage weigh differently across the five rules. The simulator computes all of them in parallel and points to the highest RMI among those already reached.

Do the 50% and 100% toll rules give the same retirement amount?

Not necessarily: the 50% toll uses the normal 60% + 2% per excess year coefficient, while the 100% toll fixes the RMI at 100% of the average wage, but in exchange requires double the time that was left on 11/13/2019, plus a minimum age that the 50% toll does not have.

Can someone who joined INSS after 2019 use the transition rules?

No. The transition rules (points, progressive age, 50% toll and 100% toll) only apply to whoever was already affiliated to the RGPS before 11/13/2019, the date EC 103/2019 took effect; whoever started contributing afterward follows only the art. 19 definitive rule.

Is the score required by the points rule always the same?

No, it rises 1 point per year from the 2019 baseline: it started at 96 points for men and 86 for women, and climbs until locking at 105 (men) and 100 (women). The simulator automatically applies the score for the year of the reference date entered.
