Art. 4 of the Brazilian Tenancy Law (Law 8,245/1991) lets a tenant return the property during the lease term by paying the agreed fee, proportional to the period the lease was performed, or, if none was agreed, the fee a judge sets. The law does not say how many rents the fee should be or whether the proportion is measured in months or days, so the calculator shows both criteria side by side: total fee times months remaining divided by the term, and total fee times days remaining divided by the days of the lease. On a 12-month lease with a fee of 3 rents of R$ 2,000, returning after 6 complete months gives R$ 3,000 by the months criterion. Beyond the fee, the real cost of leaving includes the days of the last month, pro-rated IPTU and condo fees and any unpaid months, and the tool adds it all up. The fee is waived when the return results from a transfer by the employer, private or public, to a location different from where the lease began, with written notice to the landlord at least 30 days ahead (art. 4, sole paragraph). The 30-day notice of art. 6 applies to leases with an indefinite term and does not replace the fee while a fixed term is running. Written leases of 30 months or more end with the term and only become indefinite if the tenant stays over 30 days without objection (art. 46), while shorter ones extend automatically (art. 47). If the landlord sells the property, the buyer cannot terminate the lease only when it has a fixed term, a survival clause and is annotated on the title (art. 8); otherwise the buyer has 90 days to ask for the property back. Finally, the fee can be reduced: art. 413 of the Civil Code has the judge reduce it equitably when the obligation was partly performed or the amount is manifestly excessive, and art. 412 bars a penalty clause from exceeding the value of the principal obligation. The result is an estimate: your lease and a judge's decision can lead to a different number.

Take the full agreed fee and multiply it by the fraction of the term that was still left. By months: fee times months remaining divided by the term. By days: fee times days remaining divided by the total days of the lease. With a R$ 6,000 fee on a 12-month lease and 6 months served, the fee is R$ 3,000 by months.
