Brazil's unemployment benefit (seguro-desemprego) is a temporary payment for workers dismissed without just cause (Law 7.998/1990, as amended by Law 13.134/2015; regulated by CODEFAT Resolution 870/2016). This calculator estimates two things: the amount of each installment and how many installments the worker is entitled to. The amount starts from the average of the last three salaries, to which the progressive brackets of the CODEFAT table, updated each year, are applied, always respecting the floor of one minimum wage. The number of installments (3 to 5) depends on the time worked since the last dismissal and the number of applications, requiring at least 12 months on the 1st application, 9 on the 2nd, and 6 from the 3rd onward. The application must be filed between 7 and 120 calendar days after dismissal (art. 7). The unemployment benefit (Law 7.998/1990, as amended by Law 13.134/2015) supports the formal worker dismissed without just cause. Besides having no sufficient own income and no incompatible social security benefit, you must prove a minimum work time in the reference period, which varies by application number: at least 12 months on the 1st, 9 months on the 2nd, and 6 months from the 3rd onward.
The application has a deadline: it must be filed between 7 and 120 calendar days after dismissal (art. 7 of Law 7.998/1990). Missing that window can mean losing the benefit. Some situations are excluded, the mutual agreement under art. 484-A of the CLT, for instance, does not grant unemployment benefit (art. 484-A, §2).
Each installment's amount starts from the average of the last three salaries. The progressive brackets of the CODEFAT table, updated every year, apply to that average: up to a first threshold, the installment is a proportion of the average; in an intermediate bracket, a fixed portion is added to a percentage of what exceeds the first threshold; above the second threshold, the table ceiling applies. No installment is below the floor of one minimum wage (R$ 1,621 in 2026).
The number of installments (3 to 5) depends on the time worked since the last dismissal and on the number of applications. On the first application, the minimum required is 12 months worked: 12 to 23 months give 4 installments, and 24 months or more give 5 installments. So an illustrative worker with an average of R$ 2,000 and 15 months worked on a first application receives 4 installments, computed from the matching bracket of the table.
The figures here are an educational estimate. The CODEFAT table is updated annually, and eligibility depends on employment links and dates recorded in the official systems. Situations such as voluntary resignation and dismissal for just cause grant no right, and receiving another incompatible social security benefit can block the benefit.
